Welcome to Job Pivotry. These Terms of Service ("Terms") govern your access to and use of our AI-powered career transition platform, including our website, services, and applications (collectively, the "Service").

By accessing or using Job Pivotry, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Account Registration and Eligibility

1.1 Eligibility

You must be at least 18 years old to use Job Pivotry. By creating an account, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• All information you provide is accurate and truthful
• You will maintain the accuracy of your account information

1.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring you log out at the end of each session

1.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion.

2. Subscription and Payments

2.1 Paid Subscriptions

Job Pivotry offers paid subscription plans that unlock access to our full suite of career tools and AI-powered features. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• You are responsible for all charges incurred under your account
• Prices are subject to change with 30 days notice

2.2 Billing and Payment Processing

Payments are processed securely through Stripe. We do not store your full credit card details. You agree to provide accurate and current billing information.

2.3 Cancellation Policy

You may cancel your subscription at any time from your account settings or by contacting us at support@jobpivotry.com. Please note:

• Cancellations take effect at the end of the current billing period
• You retain access to all paid features until the end of your billing period
• No refunds are issued for partial or unused subscription periods unless you qualify under our refund policy below

2.4 Refund Policy — 7-Day Satisfaction Guarantee

We stand behind the value of Job Pivotry and offer a 7-day refund window from the date of your initial purchase. To be eligible for a refund, all three of the following conditions must be met:

1. Submit within 7 days. Your refund request must be emailed to support@jobpivotry.com within 7 calendar days of your purchase date.
2. Provide a rationale. Your request must include a clear explanation of your dissatisfaction — what didn't work for you, what you expected, or specific feedback or complaints about the platform. This helps us improve the product for everyone.
3. Show proof of effort. We ask that you demonstrate you gave the platform a genuine try. This can include a screenshot showing tools you used, features you explored, resumes or documents you generated, or any other evidence of meaningful engagement with the platform.

Refund requests that meet all three conditions will be reviewed and processed within 5–7 business days. Approved refunds are issued to the original payment method. Refund requests submitted after 7 days, or that do not include a rationale and proof of effort, are not eligible under this policy. We reserve the right to decline requests that appear to be submitted in bad faith.

3. Acceptable Use

3.1 Permitted Use

You may use Job Pivotry for lawful personal career development purposes only, including:

• Uploading your resume and receiving an AI-powered career analysis
• Exploring AI-identified career pivot opportunities tailored to your background
• Creating and optimizing role-specific resumes with AI assistance
• Generating personalized cover letters for target roles
• Preparing for interviews with AI-generated questions and mock sessions
• Accessing role-specific crash courses and learning content for skill development
• Browsing curated job listings aligned to your target role
• Using the AI Career Coach for real-time career guidance and Q&A
• Building a project portfolio to showcase your work
• Creating and publishing a professional web portfolio
• Generating recruiter outreach emails with personalized messaging
• Researching salary ranges, benchmarks, and negotiation strategies
• Crafting a narrative framing of your career story and professional brand
• Generating resignation letters and career transition documents
• Booking 1:1 career coaching sessions with human coaches

3.2 Prohibited Activities

You agree NOT to:

• Share your account credentials with others
• Use the Service to create false, misleading, or fraudulent resumes or documents
• Scrape, copy, or reverse engineer any part of our platform
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to spam, phish, or distribute malware
• Violate any applicable laws or regulations
• Resell, redistribute, or sublicense access to the Service
• Use automated tools (bots, scrapers) to access the Service
• Upload content that infringes on intellectual property rights
• Interfere with or disrupt the Service or servers

3.3 Consequences of Violations

Violations of these Terms may result in immediate account suspension or termination without refund, and we may pursue legal action if necessary.

4. AI-Generated Content and Accuracy

4.1 AI-Powered Features

Job Pivotry uses artificial intelligence (OpenAI's GPT models) to power many features including career analysis, resume optimization, cover letters, interview preparation, career pivot recommendations, AI Career Coach, crash courses, salary research, negotiation guidance, narrative framing, web portfolio generation, and recruiter outreach emails. You acknowledge that:

• AI-generated content is based on algorithms and may not always be accurate or complete
• You are responsible for reviewing and verifying all AI-generated content before use
• AI recommendations are suggestions, not guarantees of career success or employment
• You should customize and personalize AI-generated documents to reflect your true experience
• AI Career Coach provides general guidance, not licensed professional career counseling

4.2 No Guarantee of Results

We do not guarantee that using Job Pivotry will result in job offers, interviews, career advancement, or any specific outcomes. Career success depends on many factors beyond our control.

4.3 Salary Projections and Estimates

Our salary analysis features provide estimates and projections based on your resume, experience, skills, and optionally your self-reported salary. Salary estimates and projections displayed within the platform are accompanied by in-app disclosures at the point of display. You acknowledge that:

• Salary estimates are AI-generated projections based on your resume, skills, and market data — not guarantees of actual earning potential
• 5-year earning projections are hypothetical scenarios based on assumptions and do not account for all variables affecting compensation
• Actual salaries vary based on location, company size, internal pay bands, negotiation, and market conditions
• We are not financial advisors and our tools do not constitute financial advice
• You should conduct your own research and consult qualified professionals before making major career or financial decisions

4.4 Career Pivot Recommendations

Career pivot opportunities suggested by our AI are based on analysis of your skills and experience. These are suggestions to explore, not guaranteed paths. Transitioning careers requires your own research, additional training, networking, and effort beyond using our platform.

4.5 Your Responsibility for Truthfulness

You are solely responsible for ensuring that all information you provide and all content in your resumes, cover letters, and other career documents is accurate, truthful, and not misleading. This includes:

• Work history, job titles, and employment dates
• Education and certifications
• Skills and experience claims
• Salary information you provide (if any)
• Career goals and aspirations

Deeper Apps LLC is not liable for any consequences arising from false, exaggerated, or misleading information in your documents or data you provide.

5. Intellectual Property Rights

5.1 Our Intellectual Property

Deeper Apps LLC and its content (excluding user-generated content) are owned by us and protected by copyright, trademark, and other intellectual property laws. This includes:

• Software, code, and algorithms
• Design, layout, and user interface
• Logos, branding, and trademarks
• Templates, frameworks, and methodologies

5.2 Your Content

You retain ownership of all content you create or upload to Job Pivotry (resumes, cover letters, personal information, portfolio content). By using our Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Use your content to generate AI-powered recommendations and documents
• Display your content back to you through our platform
• Create anonymized, aggregated analytics (with no personally identifiable information)

We will never sell your personal content to third parties or use it for purposes beyond providing the Service.

5.3 License to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Job Pivotry for your personal career development purposes only.

6. Public Web Portfolio

6.1 Portfolio Feature

Job Pivotry offers an optional feature to create and publish a professional web portfolio. If you choose to use this feature, portions of your profile and career information may be made publicly accessible via a unique URL.

6.2 Your Responsibility for Public Content

By publishing a web portfolio, you acknowledge that:

• Content on your portfolio is publicly accessible to anyone with the link
• You are responsible for the accuracy and appropriateness of all published content
• You have the right to share any information included in your portfolio
• Published content must not violate any third-party rights (e.g., employer confidentiality)
• You can unpublish your portfolio at any time from your account settings

6.3 Content Restrictions

Your public portfolio must not contain illegal content, hate speech, harassment, misleading information, or content that violates others' intellectual property rights. We reserve the right to remove portfolios that violate these terms.

7. Third-Party Services and Links

7.1 Third-Party Service Providers

Job Pivotry uses third-party services to provide our platform, including:

• OpenAI — For AI-powered career analysis, content generation, AI Career Coach, and learning content
• Stripe — For payment processing
• Supabase — For data storage and authentication
• Vercel — For hosting and delivery
• Resend — For transactional emails
• Google — For OAuth authentication (if you sign in with Google)

Your use of these third-party services is subject to their respective terms and privacy policies. By using Job Pivotry, you acknowledge and agree to the use of AI features that process your data through OpenAI's API as described in our Privacy Policy.

7.2 External Links

Our Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of these external sites. Use them at your own risk.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Job Pivotry, you consent to the collection and use of your data as described in our Privacy Policy, including:

• Transmission of your resume and career data to OpenAI's API for AI-powered features
• Storage of AI Career Coach conversation history
• Processing of salary information you provide (if any) for career recommendations
• Publication of portfolio content you choose to make public

9. Disclaimers and Limitations of Liability

9.1 Service Provided "As Is"

Job Pivotry is provided by Deeper Apps LLC on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of AI-generated content
• Warranties that defects will be corrected

9.2 Limitation of Liability

To the maximum extent permitted by law, Deeper Apps LLC and its affiliates, officers, employees, and partners shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from use or inability to use the Service
• Damages from errors, inaccuracies, or omissions in AI-generated content
• Damages from unauthorized access to or alteration of your data
• Damages from third-party services or external links

In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9.3 Career Advice Disclaimer

Job Pivotry provides career tools and AI-generated recommendations, but we are not a licensed career counseling or recruiting service. Our suggestions should not be considered professional career advice. For personalized guidance on significant career decisions, we recommend consulting with a qualified career professional.

10. Indemnification

You agree to indemnify, defend, and hold harmless Deeper Apps LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit, upload, or create using our Service
• Any false, misleading, or fraudulent information in your resumes or career documents

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date at the top
• Sending you an email notification (for significant changes)

Your continued use of Job Pivotry after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us at support@jobpivotry.com or through your account settings. Upon termination, you will lose access to all paid features, though you may retain access until the end of your billing period.

12.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• We suspect fraudulent, abusive, or illegal activity
• Your account remains inactive for an extended period
• We discontinue the Service (with reasonable notice)

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will remain in effect.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

13.2 Dispute Resolution

In the event of a dispute, you agree to first contact us at support@jobpivotry.com to attempt to resolve the issue informally. If we cannot resolve the dispute within 30 days, either party may pursue legal action.

13.3 Arbitration

Any disputes arising out of these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except for claims in small claims court or intellectual property disputes.

14. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deeper Apps LLC regarding your use of the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, wars, pandemics, or infrastructure failures.
